Canada’s Temporary Foreign Worker Program Reforms

On October 21, 2024, the Canadian government made an important announcement regarding major changes to the Temporary Foreign Worker Program. When the TFW program was introduced, it was done with the purpose of using it as a unique solution when no qualified Canadian worker is available to fulfill a specific job. The program was supposed to be used as a temporary solution. However, review suggests otherwise that, high number of immigrant applicants have been migrating through this visa pathway ever since. This is why Minister Randy Boissonnault, responsible for Employment, Workforce Development, and Official Languages stated that the reason behind these changes lies in preserving the integrity of TFW program by aiming to prioritize Canadian workers. He says, “This change to the Temporary Foreign Worker Program reinforces our commitment to protecting temporary foreign workers while prioritizing the Canadian workers available to join the labour force.” 

Key Changes to the TFW program 

Currently there is an imbalance of supply and demand between Canadian jobs and Canadian workers. Due to high number of immigrants, the country is now facing a shortage of jobs for its national residents. In September 2024, for instance, the youth unemployment rate was at 13.5%, much higher than the national average of 6.5%. To battle this, Canada has made a broader commitment to prioritise domestic workers, especially those who come from underrepresented groups, like youth, indigenous people, disabled individuals and women!  

The TFW program has two components, differentiated by the level of wage offered. One is high wage stream, and another is low wage stream. Effective November 8, 2024, the minimum starting hourly wage for high-wage stream under TFW will witness a 20% hike in each province or territory. Depending on the location, an increase of 5 to 8 dollars/hour can be expected above the median wage. 

This will lead to 34,000 high salary job positions move down to the more regulated low-wage stream. This transition will help to ensure stricter employer obligations regarding housing, transportation and recruitment of domestic workforce in Canada. As a result, TFW program will accept 20,000 lesser applications than it usually does.  

New Measures for Program Integrity 

Other than regulating the low wage streams of TFW program, the Canadian government has also targeted to improve the legitimacy of employers taking part. Starting on October 28, 2024, Canadian businesses can no longer use attestations from professional accountants or lawyers to validate their legitimacy. Moving on, the government will heavily rely on data-sharing agreements which are in place with the provincial and territorial partners already. This will help to ensure genuine job offers and prevent any misuse of the program. 

What Employers Need to Know?

Employers using the TFW Program should be aware of the following updates: 

  • High-wage stream positions will require wages 20% above the local median wage. 
  • More positions will fall under the low-wage stream, which includes stricter requirements for housing, recruitment, and transportation. 
  • Attestations from third-party professionals will no longer be acceptable for proving business legitimacy. 
  • LMIAs will continue to play a critical role in assessing the potential impact on the Canadian labour market before hiring temporary foreign workers. 

While it has been seen that most employers follow the guidelines given in the TFW program properly, the Canadian government still needs to remain vigilant. There is a possibility of more adjustments being done to the program. This will be based on the data received by continuous monitoring for fraud, misuse and shifts in labour market. For employers, these changes highlight the importance of compliance and thorough preparation when participating in the TFW Program. For temporary foreign workers, they represent a step towards improved protection and fair treatment.
