People who have enduring physical disabilities, chronic medical issues, or a need for social services and benefited from Immigration, Refugees, and Citizenship Canada’s (IRCC) interim policy four years ago can now breathe a sigh of relief as the policy was made permanent in March. This has a direct impact on immigration to Canada.
To address modifications to the medical inadmissibility excessive demand policy, the Minister of Immigration, Refugees, and Citizenship Canada presented a temporary public policy on June 1, 2018. This was done in anticipation of regulatory amendments that would be implemented later.
The public policy eliminated some services, such as special education, from the cost analysis and made a threefold increase in the cost threshold of excessive demand. Additionally, if foreign countries met the requirements outlined in the public policy, assessing officers could exempt them from the public policy’s ban on admission based on excessive demand.
The Immigration and Refugee Protection Regulations (IRPR) have been modified as of March 4, 2022, after the temporary public policy change of 2018. The IRPR has undergone the following modifications:
- The threshold for excessive demand costs for foreign nationals moving temporarily or permanently to Canada has been raised to three times the average cost per person in Canada.
- Health services and social services, both, have been redefined, and references to some social services, like special education, social rehab, and individual support services, have now been removed.
- It has also been made clearer which agents are responsible for evaluating medical as well as non-medical data for applications.
- In assessing the costs of excessive demand for health and social services, the exceptional 10-year period has been eliminated.
These changes will encourage the inclusion of those who, despite their health issues, can benefit Canada, including people with disabilities.
